Terms and Conditions

1. General

1.1. These Terms and Conditions (“Terms”) apply to participation in, collaboration with, and activities organized by Weave Pictures (“Weave Pictures”, “the Association”, “we”, “us” or “our”).

1.2. Weave Pictures is a voluntary, non-profit film association established and operating in Denmark.

1.3. Weave Pictures exclusively produces short films and activities directly related to the development, production, presentation, promotion and distribution of short films.

1.4. These Terms apply to members, volunteers, actors, filmmakers, crew members, collaborators, participants, ticket purchasers, visitors and other persons participating in or interacting with Weave Pictures, to the extent relevant to their relationship with the Association.

1.5. By participating in a Weave Pictures activity, purchasing a ticket, submitting material to Weave Pictures, or otherwise entering into an agreement with Weave Pictures, the person concerned accepts these Terms to the extent applicable.

2. Voluntary and Unpaid Participation

2.1. Participation in Weave Pictures’ activities and film productions is voluntary and unpaid, unless otherwise expressly required by mandatory law.

2.2. Membership of Weave Pictures does not entitle a member to salary, wages, fees, honoraria, or other remuneration.

2.3. Persons recruited, invited or otherwise engaged to participate in a Weave Pictures film production—including actors, directors, writers, cinematographers, editors, sound personnel, production personnel, designers and other contributors—participate on a voluntary and unpaid basis unless a separate written agreement expressly provides otherwise and such agreement is lawful.

2.4. In particular, actors participating in Weave Pictures productions are not entitled to salary, acting fees or honoraria from Weave Pictures solely by reason of their participation.

2.5. Reasonable, documented expenses may be reimbursed where approved by Weave Pictures and permitted under applicable law. Reimbursement of genuine expenses does not constitute remuneration.

2.6. Nothing in these Terms excludes any payment, compensation or other entitlement that cannot lawfully be excluded under mandatory Danish law.

3. Participation in Film Productions

3.1. Participation in a Weave Pictures production is subject to the production’s requirements, schedule, artistic direction and practical arrangements.

3.2. Weave Pictures may determine the allocation of roles, production responsibilities, shooting schedules, locations and other production matters.

3.3. Participation does not guarantee that a person will appear in the final film or that any submitted or recorded material will be used.

3.4. Weave Pictures may edit, shorten, rearrange or otherwise modify recorded material as reasonably necessary for the production, subject to applicable law and any specific written agreements.

3.5. Participants must follow reasonable production instructions concerning safety, scheduling, locations, equipment and professional conduct.

4. Intellectual Property

4.1. Copyright and other intellectual property rights remain with their respective rights holders unless they have been lawfully assigned, licensed or otherwise made available to Weave Pictures.

4.2. Persons contributing original material to a Weave Pictures production retain their rights unless a separate written agreement provides otherwise.

4.3. Where Weave Pictures requires rights to use a contribution in a film or related project, the relevant rights should, where appropriate, be established through a written agreement or other legally valid permission.

4.4. Participants must not knowingly provide or use material in a Weave Pictures production that infringes another person’s copyright, trademark, privacy, image rights or other legal rights.

4.5. This includes, where applicable, music, photographs, video, scripts, artwork, recordings, locations, trademarks and other protected material.

4.6. Weave Pictures may use completed films and associated promotional materials for purposes consistent with its objectives, including screenings, premieres, festivals, competitions, websites, social media, promotional activities and lawful distribution, subject to applicable rights and agreements.

5. Image, Video and Audio Recording

5.1. Film productions, premieres, screenings, workshops and other Weave Pictures activities may involve photography, video recording and audio recording.

5.2. Persons participating in a production may be recorded as part of that production where this has been agreed or otherwise lawfully established.

5.3. Photographs, recordings and other material from public or Association activities may also be used for legitimate documentation and promotion of Weave Pictures, subject to applicable Danish law.

5.4. Where a person’s consent is legally required for a particular use, Weave Pictures will obtain such consent in an appropriate form.

6. Tickets and Events

6.1. Weave Pictures may organize premieres, screenings, film events, workshops and other activities connected with its purpose.

6.2. Weave Pictures may charge admission and sell tickets for premieres and screenings.

6.3. Ticket prices, availability, venue, date and time will be stated in the relevant event information.

6.4. A ticket is valid only for the event and conditions specified at the time of purchase.

6.5. Tickets may not be resold for commercial gain unless Weave Pictures expressly permits this.

6.6. Weave Pictures may refuse admission where reasonably necessary for safety, venue requirements, capacity restrictions, or serious violations of these Terms.

6.7. If an event is cancelled or materially changed, Weave Pictures will handle refunds or alternative arrangements in accordance with applicable Danish consumer law and the specific circumstances.

6.8. Nothing in these Terms limits mandatory consumer rights applicable to ticket purchases.

7. Payments and Income

7.1. Weave Pictures may receive income from lawful sources, including ticket sales, membership fees, donations, grants, sponsorships, fundraising and revenue directly connected with its film activities.

7.2. All income and financial support received by Weave Pictures must be used in accordance with its bylaws and exclusively to further its film-related objectives.

7.3. Weave Pictures does not distribute profits, dividends or surplus to members, board members or private individuals.

7.4. Any surplus remains within the Association and may be used for future short-film productions and activities directly related to its purpose.

8. Donations, Grants and Sponsorships

8.1. Weave Pictures may accept donations, grants, sponsorships and other financial or material support.

8.2. Such support must be consistent with the Association’s purpose, values and independence.

8.3. A donor or sponsor does not automatically acquire ownership, copyright or editorial control over a Weave Pictures production by providing financial or material support.

8.4. Any specific rights or obligations granted to a donor or sponsor must be agreed separately and in writing where appropriate.

9. Code of Conduct

9.1. Weave Pictures aims to maintain a safe, respectful and inclusive environment.

9.2. Participants, members, volunteers and guests must treat one another with respect.

9.3. Harassment, bullying, discrimination, threats, intimidation, violence and other seriously inappropriate conduct are not permitted.

9.4. Weave Pictures may take reasonable measures in response to violations, including removing a person from an activity, suspending participation or terminating a person’s involvement in accordance with the bylaws and applicable law.

9.5. Where children or young persons participate, Weave Pictures will comply with applicable Danish laws and safeguarding requirements.

10. Health, Safety and Equipment

10.1. Participants must follow reasonable health and safety instructions during productions and events.

10.2. Participants must handle Association property and production equipment responsibly.

10.3. Association equipment may only be used for authorized purposes unless otherwise agreed.

10.4. A participant may be responsible for loss or damage caused by intentional or negligent conduct to the extent permitted by Danish law.

11. Personal Data

11.1. Weave Pictures may process personal data where necessary for membership administration, production management, event administration, ticket sales, communication, accounting, legal compliance and other legitimate Association purposes.

11.2. Personal data will be processed in accordance with applicable data-protection legislation, including the EU General Data Protection Regulation (GDPR) and applicable Danish legislation.

11.3. Where required, Weave Pictures will provide separate privacy information explaining what personal data is collected, why it is processed, the legal basis for processing, retention periods and applicable data-subject rights.

12. Website and Digital Content

12.1. Content published by Weave Pictures on its website, social-media channels or other digital platforms may include films, photographs, artwork, text, logos, production information and other material.

12.2. Unless otherwise stated, such content may not be copied, reproduced, modified, distributed or commercially exploited without appropriate authorization.

12.3. Third-party trademarks, works and other protected material remain the property of their respective rights holders.

12.4. Weave Pictures may remove, modify or update digital content at any time where reasonably necessary.

13. Third-Party Services and Links

13.1. Weave Pictures may use third-party services for ticketing, payment processing, hosting, communication, distribution or other purposes.

13.2. Where a third-party service is used, that provider’s own terms and privacy policies may also apply.

13.3. Weave Pictures is not responsible for the content or availability of third-party websites or services except to the extent required by applicable law.

14. Liability

14.1. Weave Pictures will act with reasonable care in organizing its activities, productions and events.

14.2. To the extent permitted by applicable Danish law, Weave Pictures is not responsible for indirect losses or losses arising from circumstances outside its reasonable control.

14.3. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from mandatory law.

14.4. Participants remain responsible for their own personal belongings unless Weave Pictures has expressly accepted responsibility for them.

15. Force Majeure

15.1. Weave Pictures shall not be liable for failure or delay in performing an obligation where this is caused by circumstances beyond its reasonable control.

15.2. Such circumstances may include, where applicable, natural disasters, fire, serious technical failures, epidemic or pandemic restrictions, government measures, strikes, war, civil unrest or other extraordinary events.

15.3. Where an event or production is affected by such circumstances, Weave Pictures will seek to provide reasonable information and, where practicable, alternative arrangements.

16. Complaints and Disputes

16.1. Questions, complaints or concerns regarding Weave Pictures’ activities should first be addressed to the Board of Weave Pictures.

16.2. Weave Pictures will seek to resolve disputes fairly and in accordance with its bylaws and applicable Danish law.

16.3. Nothing in these Terms prevents a person from exercising statutory rights or pursuing remedies available under mandatory Danish law.

17. Changes to These Terms

17.1. Weave Pictures may amend these Terms where reasonably necessary to reflect changes in its activities, applicable law or organizational circumstances.

17.2. Material changes will be communicated through an appropriate channel where reasonably practicable.

17.3. Changes to the Association’s fundamental organizational rules, purpose or non-profit principles are governed by the Association’s bylaws and not solely by these Terms.

18. Relationship with the Bylaws

18.1. These Terms supplement the Vedtægter for Weave Pictures.

18.2. If these Terms conflict with the bylaws, the bylaws shall prevail as regards the internal organization and governance of Weave Pictures.

18.3. Mandatory Danish law shall prevail over both these Terms and the bylaws to the extent that either conflicts with mandatory law.

19. Severability

19.1. If any provision of these Terms is held to be invalid, unlawful or unenforceable, the remaining provisions shall remain in effect to the extent permitted by applicable law.

19.2. The invalid provision shall, where legally possible, be interpreted or replaced in a manner that most closely achieves its original lawful purpose.

20. Governing Law

20.1. These Terms are governed by Danish law.

20.2. Any dispute shall be handled by the competent Danish courts, subject to any mandatory jurisdictional or consumer-protection rules.

1. Introduction

1.1. This Privacy Policy explains how Weave Pictures (“Weave Pictures”, “the Association”, “we”, “us” or “our”) collects, uses, stores and otherwise processes personal data.

1.2. Weave Pictures is a voluntary, non-profit film association established and operating in Denmark.

1.3. Weave Pictures takes the protection of personal data seriously and processes personal data in accordance with applicable data-protection legislation, including the EU General Data Protection Regulation (GDPR) and applicable Danish legislation.

1.4. This Privacy Policy applies to personal data processed in connection with, among other things:

membership of Weave Pictures;
participation in film productions;
actors, filmmakers, crew members, volunteers and other contributors;

3. What Personal Data We May Collect

Depending on the person’s relationship with Weave Pictures, we may process different categories of personal data.

3.1. Identification and contact information

3.2. Membership information

Because Weave Pictures produces films, we may process:

3.5. Ticket and event information

For premieres, screenings and other events, we may process:

Payment-card details are normally processed by the relevant payment provider rather than stored directly by Weave Pictures.

4. How We Collect Personal Data

We may obtain personal data:

directly from the person concerned;
when a person becomes a member;

5. Purposes of Processing

5.2. Film production

Marketing communications will be carried out in accordance with applicable law.

5.5. Legal and financial obligations

establish, exercise or defend legal claims;
comply with lawful requests from public authorities; and
protect Weave Pictures’ legitimate interests.
6. Legal Bases for Processing

Weave Pictures processes personal data only where there is a lawful basis for doing so under applicable data-protection legislation.

Depending on the circumstances, the legal basis may include:

6.1. Consent

Where processing is based on consent, consent will be requested where required.

A person may withdraw consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.

6.2. Contract or agreement

7.1. Film production necessarily involves the recording and processing of personal data relating to actors, crew members and other persons appearing in or contributing to productions.

7.2. Weave Pictures may use lawfully obtained audiovisual material for purposes connected with the relevant film production, including:

editing and post-production;
completed films;
premieres and screenings;
film festivals and competitions;
lawful distribution;
trailers and excerpts;
websites;
social-media platforms;
promotional materials; and
documentation of Weave Pictures’ activities.

7.3. The specific legal basis and permitted uses may depend on the circumstances and on any agreement or consent applicable to the individual production.

7.4. Where appropriate, Weave Pictures may enter into separate release forms, participation agreements, contributor agreements or other written agreements addressing the use of a person’s image, performance, voice or other contribution.

7.5. A person appearing in a film does not automatically have the right to demand that a completed production be removed solely because they subsequently change their mind, where Weave Pictures has a valid legal basis and applicable rights to use the material.

7.6. Nothing in this section limits rights that cannot lawfully be excluded under applicable Danish or EU law.

8. Special Categories of Personal Data

8.1. Weave Pictures generally does not seek to collect special categories of personal data, such as information concerning health, political opinions, religious beliefs, sexual orientation or biometric data.

8.2. If special-category personal data becomes necessary for a specific activity, Weave Pictures will process it only where an appropriate legal basis and applicable exception under the GDPR exist.

8.3. Persons should not voluntarily provide sensitive personal information to Weave Pictures unless it is reasonably necessary for the relevant purpose.

9. Children’s Personal Data

9.1. Weave Pictures may involve children or young persons in film productions or events.

12.2. When a person interacts with such platforms, the platform’s own privacy policy and terms may apply.

12.3. Weave Pictures may have limited control over how those platforms process personal data.

12.4. Where Weave Pictures publishes a person’s image, performance or other material, the publication will be based on an appropriate legal basis and, where applicable, relevant agreement or permission.

13. Cookies and Website Technologies

13.1. The Weave Pictures website may use cookies or similar technologies.

13.2. Cookies may be used for purposes such as:

necessary website functionality;

analytics or other optional functionality, where lawfully permitted.

14. Data Retention

14.4. Audiovisual material incorporated into a completed film may need to be retained for the lifetime of the production and its lawful distribution, archival or historical use.

14.5. When personal data is no longer required, Weave Pictures will delete, anonymize or otherwise securely dispose of it where appropriate.

15. Data Security

15.1. Weave Pictures takes reasonable technical and organizational measures to protect personal data against:

unauthorized access;
unauthorized disclosure;
accidental loss;
destruction;
alteration; and
other unlawful or unauthorized processing.

15.2. Access to personal data will be limited to persons who reasonably need access for their role or responsibilities.

15.3. No method of electronic storage or transmission can be guaranteed to be completely secure. However, Weave Pictures will take reasonable measures appropriate to the risks involved.

16. Data Breaches

16.1. If Weave Pictures becomes aware of a personal data breach, it will assess the breach and take appropriate measures in accordance with applicable GDPR and Danish requirements.

16.2. Where notification to the Danish Data Protection Agency or affected individuals is legally required, Weave Pictures will make such notification within the applicable time limits.

17. Your Rights

Subject to the conditions and limitations provided by applicable law, individuals may have the right to:

request access to their personal data;
request correction of inaccurate or incomplete personal data;
request deletion of personal data;
request restriction of processing;
object to certain processing;
receive personal data in a portable format where the right to data portability applies;
withdraw consent where processing is based on consent; and
lodge a complaint with the relevant supervisory authority.

17.2. These rights are not absolute. For example, Weave Pictures may be required to retain certain information by law or may have legitimate grounds for continuing certain processing.

18.4. If Weave Pictures does not take action on a request, the person concerned will be informed of the reasons and of their right to lodge a complaint with the relevant supervisory authority, where applicable.

19.1. If a person believes that Weave Pictures processes their personal data unlawfully, they are encouraged to contact Weave Pictures first so that the matter can be investigated.

19.2. Individuals also have the right to lodge a complaint with the Danish Data Protection Agency (Datatilsynet) where applicable.
